2 indicted on murder, other charges after shooting inside crowded van

MEMPHIS, TN (WMC) - Two men have been indicted on premeditated first-degree murder and other charges for allegedly firing into a moving vehicle with six men inside last summer in South Memphis.

A 58-year-old man in the vehicle was killed and two others were wounded.

Darion Marvell Davis, 23, and Mardi Maxwell, 25, also were indicted on five counts of attempted first-degree murder, and five counts of employment of a firearm in the commission of a dangerous felony.

Davis was also indicted as a convicted felon in possession of a handgun and faces possible enhanced punishment if convicted.

The shooting happened July 20, 2018 at about 6:30 p.m. as a black GMC Yukon carrying six men struck an outside rearview mirror of a parked vehicle in the 1500 block of Ely Street south of South Parkway East.

Several of the victims said they started to pull over, but that someone started shooting at them, killing Harold Hayes, 58, who was in the right front passenger seat.

Another man, 53, in the second seat was struck in the back and a third man, 35, was shot in the hand.
