Mother of Herenton's child wants pension frozen

MEMPHIS, TN (WMC-TV) - The mother of former Memphis Mayor Willie Herenton's young son is taking legal action to freeze Herenton's pension until child support arrangements are modified.

Claudine Marsh's attorneys say Herenton understated his income, and has failed to provide medical insurance and plan for the financial future of his son Michael, who turns five this week. 

"We're not asking the court to treat this or Mr. Herenton differently than we would any other non-custodial parent who voluntarily quits their job and drops their child's health insurance," said attorney Patricia Woods.

They are asking that the former mayor's city pension, a lump sum of over $500,000, be frozen until the court can determine how much should go to the care of his minor son.

Woods says Herenton has not missed any of his $2,100 a month child support payments, and he visits Michael for several hours each month. Attorneys say Herenton agreed to visit the child 80 days a year and spend at least one whole day with him.

"What she wants is for Mr. Herenton to be a father to his son," said Woods.

Marsh is unemployed and lives in Georgia.

Herenton had no comment Thursday evening.
