Family demands answers about investigation into fatal crash

MEMPHIS, TN (WMC-TV) - A Memphis police officer has been charged with hitting and killing a woman while behind the wheel of his squad car.  The accident happened in March, leaving the victim's family to ask why the accident report is still not done.

Tuesday, family members said they can't seem to get answers about the investigation of the crash that killed Stephanie Montague.

"We are outraged about this," said Montague's sister, Tomica Williams.

Family members are still waiting for the final accident report to be released.  They say they only have the preliminary findings, and the unknown is taking a toll on the family.

"We want this guy to be shown to the city," said Montague's nephew, Josh Paul. "To be shown to everybody who this guy is, what he did."

Officer Mark Weatherly was charged Friday with vehicular homicide and two counts of aggravated assault.  His cruiser slammed into Montague's car as she turned onto Rangeline in a blind spot just over a small hill.

"They're supposed to be protecting the law, but they're speeding," Paul said. "They killed my auntie."

Weatherly's criminal indictment say he, "unlawfully and recklessly kill Stephanie Montague by the operation of a motor vehicle" and that her death was the result of his conduct.

The second and third counts are for the injuries to a 17-year-old passenger in Montague's car, who suffered critical injuries.  They both say he recklessly committed assault on the teen.  One count says he used or displayed "a deadly weapon," his police cruiser.

"How could you be driving 102 on the streets of Memphis, Tennessee like that?" Williams asked.

The  Tennessee Highway Patrol has not confirmed the officer's speed, and officials say cannot comment because the investigation is ongoing.

Meanwhile, Officer Weatherly is out on bond and working in a non-enforcement position during the investigation.
