Family to bury baby as investigation continues

MEMPHIS, TN (WMC-TV) - Family and friends are preparing to remember a Mid-South baby who died last weekend as investigators continue to piece together loose ends in the case.

Wynter Roberts, who was 10-months-old when she died last weekend, will be buried Saturday.  As her family grieves, her accused killer remains in juvenile court custody. Jasmine Malone,16, is charged with first-degree murder in perpetration of aggravated child abuse.

Friday, District Attorney General Bill Gibbons' office said prosecutors have not yet determined if they will seek a transfer to adult court at 201 Poplar.  If they so decide, they must present their argument in juvenile court, where a judge would have to decide whether there is probable cause to proceed with the case,

The judge would also decide whether Malone deserves to be punished in the adult system, or rehabilitated in the juvenile system.

Meanwhile, the Tennessee Department of Human Resources says 4474 Grinstead, the house where the baby died, does not qualify as a daycare.  Friday, the owner of the property said it was one of 12 he rents out across the city.

According to state law, babysitters must have a state license if they care for five or more unrelated children for three or more days per week for three or more hours per day.

Officials said the Grinstead address did not have a license, but may not have need one.
