BARTLETT, TN (WMC-TV) - A Cordova man who admitted to police that he shot at a bicyclist while driving along Germantown Road is now out on $75,000 bond.
Police say the gunman's passenger told them quote..."The shots had been fired by Mashburn because they saw a male riding on a bicycle and he looked like a 'crackhead' so they wanted to 'scare' him"
A Bartlett Police officer on patrol in the 31-hundred block of North Germantown Road heard four gunshots come from a dark colored pickup at 4:30 Sunday morning.
After the officer heard the shots, he saw a bicyclist coming from the same spot where he heard the shots fired. The cyclist was not hit.
Officers pulled the pickup over, searched it for weapons and found a handgun that was missing four rounds.
Police say Brian Mashburn, 36, confessed that he did fire the four shots while he was driving the car. He added that he had consumed "a few intoxicating beverages.'
Mashburn is charged with reckless endangerment, unlawful possession of a weapon while intoxicated, and two counts of possession of a prohibited weapon.
Mashburn is not charged with driving under the influence. A Bartlett Police spokesperson said the officer obviously didn't feel Mashburn's driving ability was impaired.
The law has a different threshold however when it comes to drinking while possessing a weapon. You are not allowed to have had any alcohol when you have a gun.
