MEMPHIS, TN (WMC-TV) - Police said a drunk driver was responsible for the crash that killed a 38-year-old man and injured three others.

Neil Heins, the owner of Neil's Bar and Grill on Madison Avenue, said he just saw Kris Terry hours before a drunk driver hit and killed him.

"Saw him last night," Heins said.  "Sitting at the bar stool over there.  Two hours later, he's gone."

Terry was in a car with Liz Agans and Jason Reynolds Flick, both waiters at Neil's.  Agans and her boyfriend, Terry, were taking Flick home after they got off work.

Police said they were going south on South Bellevue when Darjae Etheridge, 26, collided with them in the intersection.

Terry was pronounced dead at The MED.  Agans and Flick were both critically injured.

"Flick has been working here a long time," Heins said.  "Flick is a good kid.  Goes to school, works, was getting ready to move back to Arkansas to take care of his grandma."

Heins said Agans recently graduated from college with a degree in art.

"Hard working little girl," Heins said.  "Cute as a button."

A female passenger in Etheridge's car was also critically injured.

After the crash, police said Etheridge, who is from Houston, Texas, tried to run away.  A Shelby County Sheriff's Deputy managed to catch him.

Heins said there is no excuse for driving drunk.

"Somebody will take you home," Heins said.  "It's why they have cabs and everything else.  You might have to find a way to get your car, but you can get your car."

Etheridge faces a multitude of charges, including driving with a revoked license, reckless driving, leaving the scene and public intoxication.
