Andy's Rest. Scorecard: Neely's On Notice

MEMPHIS (WMC-TV) - They're Food Network stars.

Their Memphis and Nashville restaurants are typically five stars.

But Oct. 8, the famous Neelys got sideways with the health inspector at Neely's BBQ, 670 Jefferson Ave.

The restaurant passed inspection with a 73, but the inspector issued a food permit suspension notice:

BROKEN water line

"pork in walk-in cooler (at unsafe food temp)

"mold & rust in ice maker"

"mold around water dispenser base"

The folks at the Neelys' corporate office in Memphis told us Pat and Gina Neely were out of town, taping their Food Network show. They connected us with Tony Neely at the Nashville restaurant.

About the issues at the Jefferson Ave. location, Tony Neely said, "You got a 40-year-old building, and the water line broke. (The inspectors) came out and said they weren't comfortable with the situation, and we (temporarily) shut the (restaurant) down to clean things up and fix the line."

Neely's BBQ on Jefferson upgraded to an 83 in its follow-up inspection.

Waffle House, 1247 S. Germantown Parkway in Germantown, TN, also barely passed with a 73. It, too, received a permit suspension notice:

"squirt bottle with blue solution not labeled"

"leak at (mop sink) backflow device"

"15 dozens of eggs sitting out at room temp on drainboard"

"We take (the eggs) out and put them back in as needed, but what are you going to tell them? Can't hurt the temperature of an egg anyway," said Johnnie Britton, the Germantown Waffle House's manager. "The biggest (violation) was the water leak. Our maintenance guy came out and fixed it."

Germantown's Waffle House awaits its re-inspection.

"We just try to be as consistent as we possibly can," said Manager Shane Reak, "making sure we've got dates on everything, time and temperatures for everything. That's what we do!"
