MEMPHIS, TN (WMC-TV) - A Memphis lawmaker called for an investigation of the Shelby County Election Commission as it plans for a special vote on the Memphis City Schools charter surrender.

Representative G.A. Hardaway of Memphis sent a letter to the editor of the Commercial Appeal and all other media outlets Friday afternoon.  He called on the FBI, TBI and District Attorney to monitor the election process.

Hardaway takes particular issue with Republican members of the Shelby County Election Commission, including chairman Bill Giannini.

Hardaway said Giannini appears to be committed to denying Memphis voters an open and fair election.

The election is tentatively planned for sometime in February.

Hardaway said concerns arose after the election commission requested an opinion from the state election coordinator on whether suburban voters should have a say on the charter surrender of Memphis City Schools.

In his letter, Hardaway wrote, "the suggestion that non-Memphis residents (in Arlington, Bartlett, Collierville, Germantown, Lakeland and Millington) should vote on the referendum submitted by Memphis City Schools is a ludicrous notion and leans toward malfeasance."

If suburban voters are allowed to participate in this election, Hardaway said he will pursue the rights of Memphis voters to be involved in the elections of Shelby County School Board members.

Giannini said that Hardaway has built a career on taking shots at the election commission.  Giannini said the election commission members have taken no public position on the charter surrender issue.
