WASINGTON (CNN) - Government prosecutors want another chance to try Roger Clemens for perjury after a mistrial last month.
The prosecutors say they made a mistake when they presented evidence that was previously ruled inadmissible at the former baseball star's trial.
Clemens' lawyers say a new trial would reward prosecutorial misconduct.
In a motion filed Friday, however, the prosecutors say their mistake was not a ploy to bail out of a bad case.
Clemens is charged with lying to Congress in 2008 when he testified that he had never used performance-enhancing drugs.
If the case results in a conviction, Clemens would face a maximum of 30 years in prison.
