(WMC-TV) - Just months ago, Dartanian Mitchell posed with his son, Luscious, and his wife, Jennifer, in their Colorado home.
Now, Luscious is dead and the couple is locked up here Memphis on theft of property charges.
"The theft stems out of an alleged burglary where the car was taken out of Colorado," attorney Terita Hewlett said.
Detectives say Mitchell was supposed to appear in court in Colorado last month to face theft charges, but instead he removed his ankle monitoring bracelet, stole a van from his employer, and took off with his wife.
She surrendered this week when Memphis police approached the van at a convenience store. He ran and police found him hiding in a nearby home.
"At this point these are still allegations, and Ms. Mitchell maintains her innocence," Hewlett said.
Jennifer Mitchell hired Hewlett to represent her just prior to a hearing Wednesday. Meanwhile, her husband was appointed a public defender.
According to investigators in Colorado, Dartanian Mitchell is a person of interest following the death of his infant son. In court Wednesday, bond was set at $250,000 for him, and $1 million for his wife.
"I guess there were some concerns about whether or not she was a flight risk," Hewlett said.
Both Dartanian and Jennifer Mitchell are due back in court October 19th.
