Judge settles Memphis-Shelby County board size

MEMPHIS, Tenn. (AP) - A federal judge has ruled that the size of the board that will govern the consolidated Memphis-Shelby County school district should be decided by the county commission.

Judge Samuel H. Mays told attorneys in the case Tuesday that the agreement reached last year allowed the Shelby County commission to create a board of up to 13 members, superseding a county charter provision governing school board size, The Commercial Appeal reports.

Attorneys said Mays rejected the argument that a referendum on the issue would have to be placed before voters.

The voter-approved merger between the county school system and Memphis City Schools it set to take place in 2013. Currently, a 23-member board is overseeing the transition to a consolidated school district.
