Police: Sex offender threw underage lingerie party

(WMC-TV) – A convicted sex offender is in trouble with the law again after he allegedly threw a lingerie party for a group of underage kids.

At his arraignment, 43-year old Charles Smith faced a variety of charges. The list includes contributing to the delinquency of a minor and violating the sex offender registry by working in a situation of direct or unsupervised contact with a minor.

"We entered a not guilty plea on both charges," said Smith's attorney Leslie Ballin. "We maintain that the facts of this case will not prove Mr. Smith guilty of any offense, either the contributing, nor the violation of the sex offender registry."

According to the affidavit of complaint, Smith is a registered sex offender. He was convicted of sexual battery against a 13-year-old in 1997.

His sentence prohibits contact with minors, but Friday night police responded to a nuisance call at a lingerie party at a building Smith owns in East Memphis.

Officers say they discovered drugs, alcohol and minors engaged in sex acts and arrested Smith.

However, Ballin maintains that his client didn't organize the party - he just happened to drop by the building with three young cousins.

"It's my understanding that the three minor children involved are his cousins and that's going to figure in greatly as to why we maintain that he is innocent - that these cousins of his were there with the permission of their mothers."

Smith is scheduled to be back in court on March 9. Meanwhile, he's out on $5,000 bond.
