Mississippi debates adding attempted murder charge

Currently, a suspect can't be charged with attempted murder in Mississippi. But there's a bill in the works to create the statute and it's expected to be debated on the house floor. (WMC-TV) – Currently, a suspect can't be charged with attempted murder in Mississippi. But there's a bill in the works to create the statute and it's expected to be debated on the house floor.

John Champion, district attorney for DeSoto County, says the bill to allow attempted murder charges in Mississippi has been a long time coming.

In fact, according to Champion, the Mississippi Prosecutor's Association has long supported adding the charge.

Mississippi does have an aggravated assault charge that carries a maximum penalty of 20 years in prison.

However, there is no attempted murder charge in Mississippi. This week, a bill to create such a law is expected to be debated on the house floor.

"It'll help us in the sense that it just gives us another tool to use as far as assessing facts," Champion said. "And once we assess the facts, determining which charge or set of facts fit better with what charges, aggravated assault or attempted murder."

The proposed legislation would require anyone convicted to serve 20 years to life in prison.

It would also give a mandatory life in prison sentence if the victim is a law enforcement officer.

"Attempted murder on a law enforcement officer, fireman, there is a long list of things included in there and does carry a life sentence," he said.
