COPY-Retrial starts in Memphis officer's shooting death

MEMPHIS, Tenn. (AP) - A man accused of shooting to death an off-duty Memphis police officer is getting a new capital murder trial after a state appeals court threw out his previous conviction.

Timothy McKinney was convicted and sentenced to death in 1999 for the shooting of 37-year-old Don Williams, who was working off-duty as a security guard at a comedy club when he was shot in the back of the neck.

The Commercial Appeal reports ( ) that McKinney's new capital murder trial will start Monday with jury selection. The Tennessee Court of Criminal Appeals awarded him a new trial in 2010 after ruling that his attorneys failed to investigate the case, prepare for trial or present evidence favorable to McKinney.
