MEMPHIS, Tenn. (AP) - A jury has been seated in the retrial of a man facing the death penalty in the fatal shooting of an off-duty Memphis police officer.

Timothy McKinney is being retried after an appeals court overturned his conviction and death sentence in the 1999 slaying of 37-year-old Don Williams. The victim was working off-duty as a security guard at a comedy club when he was shot in the back of the neck.

The Commercial Appeal reports the jury selected Monday will be sequestered.

The Tennessee Court of Criminal Appeals awarded McKinney a new trial in 2010 after ruling that his attorneys failed to investigate the case, prepare for trial or present evidence favorable to him.
