(WMC-TV) - Federal prosecutors have until Jul. 30 to decide if two inmates charged with kidnapping and killing a businessman will face the death penalty.
Ricky Wedgeworth and Darian "Drake" Pierce were captured in Memphis in March 2011. The two were on the run after escaping from a Louisiana prison work detail, and stealing a state van.
Investigators say while the two were on the run, they carjacked and killed David Cupps in Vicksburg, Mississippi. Cupps' body was found dumped more than 200 miles away in Alabama.
Days later, Investigators say the two tied up a Madison County, Tenn. worker and stole his truck.
They are also charged with conspiracy and transporting a stolen vehicle.
Both men have pleaded not guilty.
