Movie theatre shooter heads to court Monday

(WMC-TV) – The man responsible for shooting up a Colorado movie theatre will appear in court Monday.

James Holmes, 24, is accused of killing 12 movie goers and injuring dozens of people during a showing of the new Batman movie, "Dark Knight Rises" on Jul. 20.

Holmes was immediately arrested after the movie theatre massacre.

Monday's hearing is considered an "initial advisement," and the Aurora District Attorney says a decision on final charges and whether or not to pursue the death penalty, will likely come later this week.
