New reaction to DA's decision not to prosecute cop who killed teen

(WMC-TV) – Shirley Thompson recalled to Action News 5 the last conversation she had with her 15-year-old son, Justin, the day after he died last September.

"He said he'd be back," Thompson said. "But he didn't make it back."

Thompson was shot and killed by off-duty Memphis Police officer Terrance Shaw during what Shaw claimed was an armed robbery attempt. The two may have known each other.

The TBI conducted a lengthy investigation. And now, four months after the shooting, the Shelby County District Attorney has decided not to take the case to a Grand Jury.

"There is insufficient evidence to create a reasonable chance for a conviction against Mr. Shaw, particularly when considered with the foreseeable defense that could be raised under the evidence," said Shelby County District Attorney General Amy Weirich in a written statement.

"I won't speculate as to what verbiage she used or why she used that terminology," said MPD Director Toney Armstrong.

Armstrong was informed of the D.A.'s decision in a letter and agreed with it based on his knowledge of the case.

"We, the Memphis Police Department, classify it as a justifiable homicide," said Armstrong.

Armstrong said he has yet to see the TBI's full report on the shooting. It is not public record under state law. However, Armstrong promised it would be made public if he gets legal clearance to release it.

Terrance Shaw remains on paid leave pending the outcome of an administrative hearing.
