Family of boy hit by car wants stiffer charges for driver

(WMC-TV) - The family of a little boy hit by a car and killed in his own driveway says they are upset with the way his death is being investigated.

Bryan Guevara, 8, was accidentally run over by someone backing out of a neighbor's driveway three weeks ago. That driver did not have a license.

Magdelena Roman Ortiz was charged for driving without a license or insurance and failure to use due care.

"We just want that person to pay for what she did to my little brother," said Magli Guevara, Bryan's sister.

"I think she was just in jail for six hours and got out the next day," said Magli.

The little boy's father has been reconstructing the accident, reliving the nightmare over and over. He says eyewitness accounts and an illustration in a police accident report do not match what the little boy's mother saw seconds after the accident.

"When she got to the place where my brother was laying on the floor that the truck was already facing forward," explained Magli.

The family wants investigators to come back to the scene and ask more questions. They hope the answers will lead to stiffer charges against the driver.

"He wants the police to say that, you know to work on the case faster or to put a hold on her so she won't be able to leave," added Magli.

Magdelena Roman Ortiz is due back in court later this month.

Prosecutors told the Guevara's there is a chance the district attorney could ask for further investigation.
