Investigation of baby shot in head continues

Charges against the second suspect in the shooting that left a one-year old child injured have been dropped.  Police say they will not charge Antonio (Tony) Demont Byrd, instead his brother will be charged.

On June 17, 2013, the child was hit in the head by the bullet that came through his Jackson, Tennessee home. The bullet did not hit the baby's brain.

Investigators interviewed additional witnesses who identified Byrd's brother, 22-year-old Justin O'Neal Byrd, as the shooter.  Police said Justin Byrd and his girlfriend had identified Tony Byrd as the shooter but recanted their statements.

Police said the shot was fired from a red Fiat in which Justin Byrd was a passenger during an argument over a burglary that Justin Byrd was allegedly involved in. Justin Byrd has been in custody on unrelated parole violation charges.
