Officers involved in deadly shooting will not be prosecuted

(WMC-TV) - The two police officers who reportedly shot a man outside an apartment complex in January will not be prosecuted at this time.

Officers Ned Aufdenkamp and Matthew Dyess encountered Steven Askew, 24, who was asleep inside a car outside the Aspenwood Apartments. According to officials, when checking on him, the officers noticed there was a gun in the car. When the two knocked on the windows, Askew reportedly did not comply with the officers' commands, but instead, pointed his gun at one of them.

Both officers fired shots at Askew, killing him.

Aufdenkamp, 30, and Dyess, 31, were relived of duty pending an investigation but returned to work in February.

According to Vince Higgins, public information officer for the Shelby County District Attorney's Office, there is "insufficient evidence of a criminal offense by the officers involved to create a reasonable chance for a conviction, when considered with the most plausible, reasonably foreseeable defense that could be raised under the evidence."
