'No Refusal' law in effect Labor Day weekend to curb drunk driving

 (WMC-TV) – There's a new law in effect this Labor Day weekend in an attempt cut down on drunk driving that could keep you from refusing a field sobriety test.

If you refuse a breathalyzer test, law enforcement now has ammunition to force you to submit to a blood alcohol test.  Over this holiday weekend, troopers will be out in force looking for drunk drivers using the new law.

"I think it's a good thing because one, it's too many people on the streets drinking and driving, and too many people getting hurt and killed," driver Jeff Hooker said. "They need to do something to catch the people who are breaking the law."

They have done something.  This will be the first Labor Day weekend officers will be using Tennessee's new No Refusal law.  There will be checkpoints across the state for the Labor Day holiday which is usually the deadliest of the year in Tennessee.

"I think it's probably appropriate because drunk driving in any form is dangerous," driver Marvin Adams said.

The "No Refusal" law was voted on by legislators last year.  It allows officers who suspect a driver is impaired to ask for a search warrant to force the driver to take a blood alcohol test if the driver refuses a breathalyzer test.

The legislature also this year passed a law that requires all convicted drunk drivers including first time DUI offenders with blood alcohol content of .08 to have an ignition interlock device installed on their vehicles.
