Former insurance agent accused of pocketing life insurance money

(WMC-TV) - A man who reportedly claimed to be an insurance agent was arraigned in general sessions court Thursday morning. He is accused of scamming senior citizens out of their money.

Jerry Gardner is locked up at 201 Poplar.

"I really don't want to see anyone locked up, but at this point when you do the crime, it's like the slogan says, you do the time," said Eric Boyland, who says his mother was scammed by Gardner.

Eric Boyland's mother, Shannon, died in early August.

"She would feed anyone. Clothes. Shelter. She was that kinda lady," said Eric.

Eric said she had been paying her insurance agent, Jerry Gardner, $146 per month for the past 15 years for a life insurance policy. But after she died, the Boyland's discovered there was no money for a funeral.

The life insurance policies are "pending" because there have been no payments.

According to an affidavit of complaint, Gardner has not been a licensed insurance agent since 2008 and he merely pocketed Shannon Boyland's money "for personal gain" to "pay his personal bills, and business accounts."

"He was sitting right next to me and told me that I have really been taking your mother's money over the years. And I'm just like... I was shocked," said Eric.

Gardner is charged with theft of property and fraudulent insurance acts. His bond is set at $2,000 ... but Eric Boyland wishes it was higher.

"My whole focus is making sure a person like that is off the streets and other family members and other people out there are not preyed on by this person. Dangerous person," he said.

Last week, another family told Action News 5 Investigators that Gardner did the same thing to them. At this point, he has not been charged in that case.

Gardner is due back in court on September 26.
