Kevin Woods appeals judge's decision for new election

Kevin Woods, who won a seat on Shelby County School Board during an August 2012 election, filed an appeal to the court over its decision to void Woods' victory over Kenneth Whalum. (WMC-TV) - A Shelby County School Board commissioner is taking action to keep his seat.

Now that the school board has dwindled from 23 members down to seven, everyone agrees decisions are made much more rapidly. But uncertainty still surrounds the seat for district four, 13 months after the election.

Serving on the school board since 2011, Kevin Woods defeated Kenneth Whalum in August 2012 by 106 votes.

"District four has always been my district," he said.

A judge recently voided the election and called for a re-vote.

Woods' attorneys have since filed an appeal to the judge's decision.

The Shelby County Election Commission says there will be no re-election until there is a ruling on Woods' appeal.

"We fully expected it. That's what the loser at the trial level has a right to do," said Kenneth Whalum, Jr.

Whalum says his attorneys filed a petition, too, in order to have Woods' appeal heard within 90 days. Otherwise, he worries the process may drag and on and until the term expires.

"It is what it is, but what it means is that the voters in district four were ignored, completely ignored," said Whalum. "And, I mean, that's just something the voters have to deal with."

Whalum believes he is the right man for the job.

"I love the children," he said.

But Woods has the same belief about himself.

"District four recognizes my work and, like I said, the legal process will work itself out," said Woods. "In the event of another election, we still believe that we'll be victorious, but in the meantime we're focused on the work."

A date has not been set to hear arguments on the appeal.

Woods remains the district four commissioner for the foreseeable future.

Whalum says he will campaign hard if given the chance.
