Accused drunk driver heads back to court

(WMC-TV) - The man Memphis police say crashed an SUV into an apartment complex while driving drunk returns to court to face a judge.

Earl Day is charged with driving under the influence and not having a driver's license.

Five people, including a pregnant woman and two toddlers, were taken to the hospital after the Ford Explorer crashed into the Pinebrook Pointe Apartments on Winchester last Wednesday morning.

According to police reports, Day told police he was swerving to avoid a dog, but a sobriety test showed he was under the influence.

He's being held on a $15,000 bond. Day first appeared in court last Thursday, but his case was reset until Monday.
