(WMC-TV) - A man released from jail after pleading guilty to killing a Memphis police officer is back behind bars, accused of trying to kill someone else.
Timothy McKinney, 39, was booked into the Shelby County Jail at 10:47 a.m. Wednesday. He is charged with attempted first degree murder, reckless endangerment, employing a firearm to commit a felony, and being a convicted felon in possession of a handgun.
Witnesses identified the shooter as a guy named "Tim."
Police say "Tim" had gotten into an argument with another man at the North Memphis Market two days earlier.
On the 23rd, police say surveillance video shows "Tim" come back to the store, peer through the window, enter the business, and confront the same man he had fought with two days prior. Police say "Tim" then pulled a gun from his right front pants pocket and fire at the other man.According to the affidavit of complaint, several other individuals were in the line of fire, including two store employees and a teenager who got hit by a bullet him his left leg. He was transported to Le Bonheur Children's Hospital in critical condition.
Police say McKinney was identified as a suspect early on in the investigation, and two witnesses identified him as the shooter in a photographic line-up.
McKinney was accused of shooting and killing Memphis police officer Don Williams on Christmas night 1997. A jury convicted him in 1999 and sentenced him to death. The conviction was overturned and two subsequent trials ended in hung juries.
"Mr. McKinney has never given a statement of admission," defense attorney Gerald Skahan said at the time. "This was a vehicle to get him out of custody."
"Though Mr. McKinney pleaded guilty to second degree murder, we are disappointed at this outcome." Williams' family said in a written statement released at the time.
"Unfortunately in this case we have to take into consideration not just the victim's family but also the entire community and the public," prosecutor Tome Anderson said at the time. "In light of that, we think this disposition is the right thing."
McKinney is being held in the Shelby County jail on $300,000 bond. He is due in court February 6.
