(WMC-TV) - One hung jury was 11-1 for a conviction. The second was 8-4 for acquittal. Now, a man who pleaded guilty to killing a police officer in order to get out of jail may ultimately face another jury.

Technically Vince Higgins and Memphis Police officer Don Williams were cousins.

"We grew up like brothers," said Higgins. "Elementary school, marbles, playground, football, the whole nine yards."

But on December 26, 1997, Williams was shot and killed outside Crumpy's Comedy Club where he was working security.

"Do we believe the punishment has been just thus far? No, we can't say that," said Higgins.

Wanya Phillips, 14, is recovering from a bullet wound to the leg after he became caught in a crossfire as he waited for change at a market.

Police say McKinney pulled the trigger in an argument with another man. Now, he is in jail on an attempted murder charge.

"Now the justice system will do what we do to make sure that justice is done in this case," said Shelby County District Attorney General Amy Weirich.

With key witnesses dead, Weirich says prosecutors had no choice but to make the 2013 deal to let McKinney walk.

"We'll handle it like any other case. Our office will represent him," said McKinney's defense attorney, Gerald Skahan, who said that his client maintains his innocence in both the Williams case and the new one.

Though Higgins says the victims in the most recent case may get his family the result they feel they have deserved.

"Mr. McKinney is entitled to a trial. We all know this. And we're just waiting for a conviction. Hopefully," said Higgins.

Skahan says McKinney's cases highlight Shelby County's problem with recidivism.

McKinney's bond is $300,000. He is due back in court February 6.
