MEMPHIS, TN -

(WMC) - The state of Tennessee indicted a former police Tuesday officer for rape. This is not the first time Darrell Malone has been in trouble with the law. 

In October 2012, a driver reported off-duty Memphis officer Malone after spotting a group of motorcyclists driving recklessly on Interstate 40 at Germantown Parkway. 

The driver told police he pulled up next to Malone and threatened to call police.  The driver claims Malone showed him his handgun in a holster and said, "I am the police."

Malone was found not guilty of that accusation. But he was later fired from the police force for getting the driver's phone number from dispatch and calling him.
