James Osgood sentenced to death in murder case

A jury has sentenced convicted killer James Osgood to death.

Osgood was convicted on Friday on two capital murder charges in the October 2010 slaying of 46-year-old Tracy Brown. Authorities say Osgood and his girlfriend Tonya van Dyke beat and sexually abused Brown before slitting her throat.

Osgood faced either life imprisonment without parole or the death penalty.

The prosecution maintains that Osgood should be sentenced to death because of the aggravated circumstances and heinous acts of cruelty surrounding Brown's death.

Osgood's attorneys point to testimony from a psychiatrist and someone who worked for DHR, which showed Osgood grew up in a troubled home environment. The witnesses said Osgood had several physiological problems and developed Rickets because he was denied milk, water and food as a child. The psychiatrist said the years of physical and sexual abuse were partly the reason that Osgood was unable to understand consequences for his actions.

His attorneys asked for a life imprisonment sentence.

A formal sentencing will be held June 13 at 9 a.m.
