MEMPHIS, TN (AP) - A former Memphis police officer accused of not taking a man to jail in exchange for sexual favors is on probation.
Brandon Berry pleaded guilty to the crime in December.
Wednesday, a judge handed down a one-year suspended sentence. The judge placed the officer on probation for two years.
Berry was a Memphis Police Officer before he was arrested in June 2013 and indicted on an official misconduct charge.
In January 2013, Berry pulled over a man with an outstanding warrant, but prosecutors say the man was forced to perform a sexual act on Berry in order to avoid arrest.
Six days later, the man went to police and told officers about the incident.
Berry then admitted to the crime and resigned from the police department.
The judge said the offense should remain on Berry's record since he violated public trust.
