MEMPHIS, TN (WMC) - The mother of a 3-year-old boy is in jail after her boyfriend allegedly beat her son so bad he had to go to the hospital.
Memphis police say the boy's mother, Katrina Johnson, did not report the abuse until the day after it happened.
"It's obviously sad," Memphian Allan Brock said. "There's a lot wrong with that story."
Anthony Gulledge, 30, came home Saturday, January 10 and discovered the young boy had eaten the last piece of cheesecake. That's when investigators say Gulledge grabbed the boy's ankle, drug him into the living room, and whipped him.
Sunday, January 11, Johnson took her son the Le Bonheur Children's Hospital. Doctors say he had a broken thigh bone, a dislocated vertebrae, and bruised lungs.
Police arrested Gulledge Sunday. Monday, they cuffed Johnson.
State law says Johnson committed a crime by waiting to report the abuse.
"Priority for her should have been to protect this child and to stop the abuse from happening," Barbara King said. She's the executive director for The Exchange Club Family Center.
Police say Johnson and Gulledge have a history of domestic violence, but King says that's not a viable excuse to let this happen.
"These children are the least able to protect themselves, and these are children that are attacked. If you did that to an adult, it'd be assault and you'd be put in jail."
Both Johnson and Gulledge are charged with aggravated child abuse. They remain in jail as of Tuesday night.
