Man accused of driving drunk and killing unborn baby is not a US citizen

MEMPHIS, TN (WMC) -

Derica Hull remains in the hospital recovering from a crash that killed two people; the man accused of killing her unborn baby stood before a Shelby County judge Thursday.

WMC Action News 5 uncovered that not only was David Diaz allegedly driving drunk and unlicensed when he hit a car, Diaz is not a US citizen and has been in the country unlawfully.

"I couldn't do nothing when they told me I lost my child," said Hull.

Hull's boyfriend, Desmond Black was driving the car with his mother and pregnant girlfriend. Black's mother also died in the crash.

"I hate this even happened to him. I hate that he was driving drunk. If he wasn't, I wouldn't be without my mother and our child," said Black.

WMC uncovered that Diaz had one prior immigration encounter where he was caught near the Mexican border, but he has never been formally deported.

A spokesperson for Immigration Customs Enforcement says they placed a immigration hold on Diaz when he was arrested. That means, if he's convicted, Diaz will serve his jail time in the U.S., then go before an immigration judge to find out his next steps.

"I'm still hurt, my family is hurt," said Black.

Diaz remains behind bars, and is due in court next week.
