MEMPHIS, TN (WMC) -

A Memphis woman will not be charged with shooting death of her estranged boyfriend. However, his niece says she won't rest until justice is served.

Joanna Johnson believes the woman who shot and killed her uncle, 49-year-old Joe Johnson, should have been charged.

"She didn't have no right to do that to my uncle -- she didn't have no right to do that," said Johnson. "I'm tired of crying, I'm tired of everything -- I am so angry."

Memphis police say Johnson was shot and killed along Selman Avenue early Wednesday during an argument with his estranged girlfriend. The woman told officers she did it in self-defense as he choked her.

Hours later, the woman posted on Facebook,"I love all of you guys this I promise and I swear y'all don't know favor like I know favor. Triple blessed."

The woman reportedly stayed on the scene after she shooting and was later questioned. But, according to an MPD spokesperson, "All evidence was presented to the DAG'S office and no charges will be filed at this point."

Johnson added, "You still living and my uncle's not here and it's really ticking me off because you're still breathing here."

Despite ongoing tensions with his girlfriend, Johnson refuses to believe her uncle's death was justified.

WMC Action News 5 reached out to the woman involved in the shooting but did not get a response.
