Judge: Brooks left address off probation order paperwork

MEMPHIS, TN (WMC) - Former Shelby County Commissioner Henri Brooks refused to put her address on her probation order, according to Judge Paula Skahan's office.

Court insiders tell WMC Action News 5's Kontji Anthony that the probation office noticed the address was missing and when they specifically asked that Brooks fill it in, she refused. Brooks' attorney says that is blatantly false.

Brooks was sentenced on Thursday for faking her address on election documents last August. She was sentenced to a two year suspended prison sentence, two years of probation, mental health treatment, and community service.

The Eiseman and Mogy Law Firm has no connection to Brooks' case, but explained why courts find an address such a critical component of the probation order.

"Mainly because they want to keep tabs on the defendant," said Brad Eiseman.

"The judges are, in essence, trusting you by allowing you not to do your time in a prison cell and instead, allowing you to do your time out on the street, so therefore it becomes that much more important that you comply with all those rules and regulations," added Eric Mogy.

It is unclear why Brooks did not write down her address, but court testimony revealed that Brooks was being stalked and someone shot up a house where she was staying.

"If you don't follow the rules of your probation, they can file a petition with the court to violate your probation and revoke your suspended sentence," Mogy added.

It could mean jail time for Henri Brooks, whose attorney says the address was inadvertently left out and she never refused to write it down. Her attorney also says the missing address was not brought to their attention until Friday, which is a non-issue because her address is elsewhere in the file.  

The form has since been fixed.
