MEMPHIS, TN (WMC) - A man accused of robbing Oak court Mall is now behind bars after police arrested him inside of church school across the street.

Memphis police officers arrested 36-year-old Daniel Foster on Tuesday after he allegedly shoplifted from Oak Court Mall. Police found a Macy's bag with 12 pairs of Rock Revival shorts worth $199.88.

According to a police affidavit, an off-duty security guard at Dillard's noticed a man leave the store with a bag full of property. Foster and another man were behind a dumpster at the mall. According to the affidavit, that's when Foster allegedly started fighting with an officer and tried to take the officer's gun.

Court records say the officer covered his gun and that's when Foster grabbed the officer's pepper spray. They were both sprayed while fighting over the pepper spray.

The suspect ended up getting away with the pepper spray and ran across Poplar Avenue and into a school at Christ United Methodist Church.  There, Foster was taken into custody by church security.

Foster remains behind bars.
