US Court of Appeals: MS county clerks must issue marriage licenses to same-sex couples

The United States Court of Appeals for the Fifth Circuit said all Mississippi county clerks must begin issuing marriage licenses to same sex-couples.

Hood released the following statement:

“The United States Court of Appeals for the Fifth Circuit has this afternoon lifted the stay of the preliminary injunction. Mississippi’s laws prohibiting same sex marriage are now officially declared unconstitutional and unenforceable by the Federal Court. This ruling makes clear that marriage licenses should be issued to same sex couples.”


Friday, when the U.S. Supreme Court ordered that all 50 states recognize same-sex marriages, Hood said he refused to issue licenses to same-sex couples.

Monday, he reversed that decision and the court officially lifted the stay Wednesday.
