Banks appears in court following abuse charges

In court Tuesday, Christian Banks’s attorney argued that his client is innocent, and that he only continued to film his son being abused to protect himself and the baby.

This was Banks’s first court appearance since the arrest. Banks surrendered Monday to U.S. Marshals.

Banks is accused of shooting the video at his girlfriend’s apartment and seeing her hold their 19-day-old son under a deflated mattress—before she threw him across the floor.

According to a new report, the child suffered a fracture to his head.

Banks’s attorney, William Massey, said his client has questions.

“Why am I being charged for taking my baby out of that situation?” Massey asked for Banks.

Banks allegedly filmed the video for more than 13 minutes before calling 911.

“I know it took a while,” Massey said. “But there was a reason it took a while,”

Banks is charged with two counts of aggravated child abuse.

Under Tennessee law, suspected abuse must be reported ‘immediately, by telephone or otherwise.’ Failure to report such is a Class A misdemeanor.

Massey said Banks continued to film because he was afraid.

“He didn’t know what she had under that deflated mattress, and so he tried to talk her out of it and give him the baby,” Massey said.

He says the baby is now in the custody of family.

The mother, at last check, was in a mental health facility.

“I’m not sure at this point if she’s been charged or not and that is kind of hard for him to understand,” Massey said.

Now, Banks plans to fight his case and fight for custody of his child.

Banks remains behind bars with a $250,000 bond. He’s expected back in court Friday.
