The family of 3-year-old Josiah is continuing to fight for justice after they said police and the court system failed them.

Josiah, or little JoJo, died Saturday. Police arrested his father, Terry Patterson the next day. He has been charged with first degree murder, child abuse and child neglect. The father had temporary custody of JoJo.

“I've been constantly telling DCS that Terry is beating my son and somebody needs to do something,” said Josiah’s mother Keara Brown.

The Department of Children Services said they're investigating and confirmed they have had prior contact with the family over the last three years.

“Of course it's really sad,” said childcare expert Amanda Russeell. “Especially in the case where it could have been preventable.”

Experts said it is important and mandatory for everyone to report any form of child abuse.

“It goes unreported so often and that's when some really bad things can happen,” Russeell said.

She said each year, 2 million cases nationwide go unreported.

For Josiah’s family, it has been a tragedy. But his case is also a wake up call for other parents.

"I don't want to look on the news and hear another parent saying the same thing I said," Brown said.
