MEMPHIS, TN (WMC) -

Two brothers accused of shooting a tow truck driver will appear before a Shelby County jury Monday.

According to police, Scotty Arnold and his coworkers were just doing their jobs as they towed cars at an apartment complex on Tulane Road and Shelby Drive in October, 2012. That's when police said Joseph Proffitt began shooting at the tow truck operators.

A bullet hit Arnold in the back as he tried to drive away from Proffitt and his brother. He survived his injuries, but was left paralyzed.

Proffitt is charged with attempted second-degree murder, three counts of aggravated assault and two counts of using a firearm during a felony. His brother, David Proffitt, faces aggravated assault charges.
