OXFORD, MS (WMC) -

Charges have been dismissed for four of the five Ole Miss fraternity members accused of assaulting another fraternity member

The five members of Pi Kappa Alpha at the University of Mississippi were charged with beating a Sigma Pi fraternity member in a suspected hazing incident in October.

The victim’s grandfather, Robert Boyle, said his grandson suffered a bruised lung, bruised ribs and a bruised groin.

“They descended upon him and beat him unmercifully. Beat him within an inch of his life,” Boyle said.

Attorneys argued the case was a prank gone wrong, where PIKE members were trying to steal a donkey statue from Sigma Pi.

A judge heard the state’s case, including testimony from the victim, Jeremy Boyle, and dismissed charges against four of the five students due to lack of proof.

Christian Guy, Austin Rice, Kyle Hughes and James Basile have been cleared of charges. Tucker Steil, however, is charged with felony assault.

All five have been kicked out of their fraternities and have been disciplined by the university.
