Sex offender found guilty of attack while on probation

MEMPHIS, TN (WMC) -

A Shelby County jury convicted a previously convicted sex offender of raping a woman while on probation.

Shelby County District Attorney General Amy Weirich said the jury needed just 10 minutes to return guilty verdicts against Donald Gwin II, 22, for aggravated rape, aggravated robbery, aggravated burglary, and aggravated assault.

In August 2014, a 28-year-old woman walked into her apartment in the Country Squire complex. A man with a knife followed her in, locked the door, raped her, choked her, and threatened to kill her family if she called police. 

The woman said the man, later identified as Gwin, tried to further intimidate her by pointing at a GPS ankle monitor he was wearing because of a previous conviction. She added that Gwin stole her phone, credit cards, and purse before leaving.

"That's horrible. That's awful and I mean, now a days it's really sad to say but you have to be very, very careful," Detrice Williams said. "Ladies are not safe if they're going to let sex offenders out like that. So, they should be careful doing things like that."

Williams works near the area where it happened, and is not alone in feeling there is a need for extra precautions.

"It makes me feel bad because you have to e careful about things like that. You know things happen," Patricia Malone said. "We definitely should be doing something about our rules or our laws for that. Because, I mean who's protecting us if nothing's being done about it."

The victim was able to identify Gwin from a photo spread, and when police confronted him the next day, he had her yellow cellphone in his pocket. He was arrested.

Weirich said Gwin was placed on probation prior to the attack in 2014 after he pleaded guilty to sexual battery in another case.

Gwin will be sentenced June 20.
