MPD: Clerk shoots would-be robber with BB gun

MEMPHIS, TN (WMC) -

A gas station clerk said he fought off a robber, but the so-called robber said the clerk shot him when all he wanted to do was buy beer.

According to police, officers responded to a robbery at the Citgo on South Perkins Road just after 3 a.m. The clerk told officers that a man came into the store, pulled out a knife, and demanded money.

The clerk was stocking shelves at the time. According to the police report, he then went to the office, grabbed a BB gun, and fired a shot at the suspect, hitting him in the leg.

The suspect ran out without taking anything. He then went to Cloister Avenue, where he called police and said he was shot while arguing with the clerk. The suspect said he tried to buy beer from the gas station, but the clerk wouldn't let him. He said he then confronted the clerk, who attacked and shot him.

The suspect, later identified as Al Rutherford, was taken to the hospital in non-critical condition.

Rutherford is charged with attempted aggravated robbery.
