MEMPHIS, TN (WMC) -

The family of Darrius Stewart is not giving up in its quest for justice in his death.

Darrius Stewart was 19 years old when he was shot and killed by Memphis police officer Connor Schilling in July 2015. Many questions remain about that night, but a grand jury returned no indictment against Schilling. Tuesday, the Department of Justice found insufficient evidence to file federal charges against Schilling.

Schilling also faced internal police charges for going against radio and handcuffing procedures, but he resigned from the department before his hearing on those charges. He received a full pension.

The Stewart family filed a lawsuit against the City of Memphis, the Memphis Police Department, Connor Schilling, and former Police Director Toney Armstrong.

Friday, a federal judge will discuss the next steps in the wrongful death lawsuit with the family, who are asking for $17 million.
