Police picked up a Memphis man Friday after he allegedly pointed a gun at his wife, then threatened to kill her as he drove down a Memphis street. The victim's son was in the backseat of the car and called police for help.

James Gates, 48, is sitting behind bars at the Shelby County Jail.

The victim said it all happened as her husband was driving east on Mitchell Road near Berea Road.  According to court records, the victim's son told police he saw Gates throw a gun out of the passenger window into a field and called police. Gates eventually parked the car on Mitchell.

According to the police report, when police showed up, Gates was acting irate, had blood shot, watery eyes, and smelled like alcohol. He told police he was drunk.

Police found the gun in a field 30 feet from the vehicle. They say the gun was stolen from DeSoto County.

Gates is charged with aggravated assault, disorderly conduct, public Intoxication and theft of property. He is due in court Monday morning.
