Byhalia man pleads guilty in suffocation death

HERNANDO, Miss. (AP) - One of three Marshall County men accused of capital murder in the death of an 83-year-old woman has pleaded guilty to a lesser charge.

Tony Earl Caradine pleaded guilty to murder yesterday in DeSoto County Circuit Court and was sentenced to life in prison.

The 33-year-old Byhalia man was arrested and charged with capital murder along with 42-year-old Ricky Scruggs and 25-year-old Mario Dockery in the December 30th, 2003, suffocation of Anna "Maxine" Andrews.

The three were arrested on April 19th, 2004, after an extensive investigation.

Caradine had been scheduled to go on trial Monday, but he agreed to plead guilty with the understanding that he would not receive a sentence of life without parole.

Prosecutors say Caradine's mental evaluation showed that he's mentally retarded and under a U-S Supreme Court ruling the death penalty could not be sought in his case.

Trials dates for Dockery and Scruggs have not been set.
