State freezes Forrest Hill Funeral Home assets

According to a news release from the Tennessee Attorney General, the assets of Forrest Hill Cemetary Company have been frozen, following a restraining order issued by Shelby County Chancellor Arnold Goldin.

Forrest Hill - and its owner Clayton Smart - own three funeral homes in the Memphis area and the restraining order prohibits the businesses operators from moving assets out of the company.

According to the statment from the Attorney General, the restraining order remains in effect pending an injunction hearing on January 23rd at 10 a.m..

The funeral homes received national media attention following reports that thousands of pre-paid burial policy owners had been told they would have to pay more for funeral services.  The State of Michigan is investigating several of the company's owners over similar complaints there.

At issue in the Tennessee lawsuit is whether the funeral home owners have violated statutes regulating cemetary trust funds.
