Prosecutors seek upgraded charges in death of baby

Prosecutors hopeful that charges against a man accused in the death of an 11-month-old girl will be upgraded are a step closer to seeing that happen.

Jasper Hendrix is in the Shelby County jail on $100,000 bond.  Thursday, he appeared in general sessions court for a preliminary hearing.

Hendrix is charged with aggravated child abuse in the death of his girlfriend's baby.

In late October, police went to an apartment in the Berclair area, where they found 11-month-old Mayka Bowen unrepsonsive. She later died at the hospital.

Hendrix, who was babysitting the girl, told investigators he went outside to put out the trash, came back in, and found the baby bleeding out of her mouth with her eyes rolled back.

Prosecutors argued the child was abused.

Thursday, judge ruled to send the case upstairs into criminal court.

Prosecutors said they would have to get more aggressive in their case.

"If the case gets bound over to the grand jury, then the case will be sent upstairs and we look forward to prosecuting him to the fullest extent of the law," District Attorney Marianne bell said.

The state says it will attempt to upgrade Hendrix's charge to first degree murder while in perpetration of aggravated child abuse.

The case now goes before a grand jury.
