Governor orders stay of execution for Pervis Payne

Friday afternoon Governor Phil Bredesen ordered a stay of execution in the case of Pervis Payne.

This came after a state appeals court had upheld a lower court ruling denying DNA testing of evidence for a death row inmate.

Payne, who was previously scheduled for execution next week, was convicted in the fatal stabbing of a Millington woman and her 2-year-old daughter in 1987 in what prosecutors called a "drug-induced frenzy."

Payne had argued that tests on bloody clothing and other evidence could exonerate him if DNA from a third, unknown person could be found.

Payne was one of several death row inmates that was seeking to have their executions delayed until the U.S. Supreme Court considers the constitutionality of lethal injection.
