MEMPHIS, Tenn. (AP) - An immigration judge in Memphis has agreed to let a Chinese couple who engaged in a seven-year custody fight for their daughter leave the United States voluntarily.

Shaoqiang and Qin Luo He would have faced deportation without the judge's approval.       Judge Lawrence Berman gave the Hes until May 2 to leave the country at their own expense.

The husband told the judge that his family expects to leave for China early next month.

The couple's immigration status had been put on hold while they fought for custody of their 8-year-old daughter Anna Mae.

The Hes placed the daughter with a Memphis couple in what they thought was temporary foster care seven years ago. The state Supreme Court overturned a judge's ruling that gave permanent custody to the American family.
