Subpoenas delivered to Beale Street business owners

A nearly decade-old lawsuit between the city and the Beale Street Development Corporation had business owners on Beale singing the blues Thursday. 

Thursday, a process server Anderson Madison delivered subpoenas to Beale Street business owners demanding each business hand over all financial records.  Madison hit the streets with 35 subpoenas Thursday, after serving 24 others two weeks ago.

Beale Street business owners declined to talk about their subpoenas.  But Juilan Bolton, who represents the Beale Street Merchants Association, responded via e-mail. 

Bolton said his clients would like to cooperate with the subpoena request but they would like to have the court's direction regarding how much of the information they are being asked to turn over is relevant to the case.

Earlier Bolton filed a court motion to quash the subpoenas, arguing that revealing the records publicly could expose the merchants to theft and reveal corporate secrets.

Bolton also argued that his clients are not even a party to the nine-year-old lawsuit against the Beale Street Development corporation.

The businesses have 30 days to respond to the subpoenas.
